The revised requirements of MARPOL ANNEX V were adopted in 2013 in order to better enforce reduction of garbage and harmful chemicals in marine environment.

MARPOL is the main international convention covering prevention of pollution of the marine environment by ships. The MARPOL Convention was adopted on 2 November 1973 at IMO (International Maritime Organization). Annex III regulates Prevention of Pollution by Harmful Substances Carried by Sea in Packaged Form. The “harmful substances” are those substances which are identified as marine pollutants in the International Maritime Dangerous Goods Code (IMDG Code) or which meet the criteria in the Appendix of Annex III.

The amendments apply to all cleaning agents and additives used for cargo hold cleaning, external surface washing and deck washing. These chemicals are treated as “operational wastes” and thus garbage under MARPOL Annex V. Cleaning and maintenance chemicals, agents or additives may be discharged into the sea, if they are not considered harmful to the marine environment. In addition the cleaning chemicals may not contain any components which are known to be carcinogenic, mutagenic or reprotoxic. A cleaning agent is also considered harmful if it is classified as "harmful substance" in accordance with the criteria in MARPOL Annex III (see classification for a marine pollutant under IMDG Code.).

The regulations are enforced by local authorities, such as government, Coast Guard or ports, and may result in fins, being stopped at sea or ejection from port.

The legislation is creating a sustainability framework and establishes the minimum environmental standard for storage, use, application and discharge of cleaning and maintenance products.
